By accessing or using the xMed EMR software service (Service), provided by Experts InfoTech (Pvt) Ltd (Company, we, us, or our), you agree to be bound by these Terms of Service (Terms). If you do not agree to these Terms, please do not use our Service.
xMed EMR is a cloud-based Electronic Medical Record solution designed to assist healthcare providers in managing patient data, appointments, billing, and clinical workflows. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without prior notice.
Registration: You must provide accurate, current, and complete information during registration.
Security: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
Liability: You are liable for all activities that occur under your account.
You agree not to use the Service to:
Customer Responsibility: As the user, you remain the sole owner of the Patient Data (including Protected Health Information). You are responsible for ensuring your use of the Service complies with all applicable healthcare laws and regulations.
Business Associate Agreement (BAA): If required by applicable law, we will enter into a separate Business Associate Agreement to govern the handling of Protected Health Information.
No Medical Advice: The xMed EMR software is an administrative tool and does not provide medical advice, diagnosis, or treatment. You rely solely on your professional medical judgment when using data from this system.
Company Property: The Service, including its software, database, design, trademarks, and logos, are the exclusive property of Experts InfoTech (Pvt) Ltd.
Your Data: You retain all rights to the data you input into the system. However, by using the Service, you grant us a license to use, copy, and process that data solely for the purpose of providing the Service to you.
Fees: Subscription fees are charged on a monthly/annual basis as selected during registration.
Changes: We reserve the right to modify our fees at any time with prior notice.
Auto-Renewal: Subscriptions will automatically renew unless cancelled at least 30 days prior to the end of the current term.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXPERTS INFOTECH (PVT) LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
You agree to defend, indemnify, and hold harmless Experts InfoTech (Pvt) Ltd and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service; or b) your violation of any term of these Terms.
By You: You may terminate your account at any time via the account settings or by contacting support.
By Us: We reserve the right to suspend or terminate your account immediately if you breach these Terms or engage in fraudulent or illegal activity.
These Terms shall be governed by and construed in accordance with the laws of Punjab/Pakistan, without regard to its conflict of law provisions.
